Week Three Case Study The following case study will be used to complete your Week 3 discussion, Search of Student Property and Person. Case Study Besides supervising lunch, one of Loretta Johnson’s favorite administrative duties was to survey the school’s perimeter. As the current Principal, she recalls when Baker Middle School (BMS) was built on the city’s border. She looked forward to the day she would attend the school but never anticipated that she would be the Principal one day! As the area developed, BMS became a bustling city full of houses and shops. Specifically, around the school’s perimeter, there were access points to businesses and yards that raised concerns over school safety. Some companies and homes had fencing and other barriers, such as a retaining wall. However, the fencing was not structurally sound in some areas, and some homes only had tall shrubs as a barrier. Budget issues prevent the school from installing a security fence, so until that can be funded and approved, the board instituted a policy called “territoriality.” The territoriality policy requires that an administrator walk the perimeter of the BMS school facilities at least one day per week to observe any abnormalities, note changes in existing barriers, and engage with the community. Principal Johnson enjoyed these walks around the entire school. On this day, the weather was lovely, and Principal Johnson made notes on neighborhood changes, fence issues, and other important details with her clipboard in hand. She also kept a keen eye out for students hiding in some of the familiar places students often found to hide. She has a post-it note with the names of students who were “missing in action” at lunchtime. Last week, she found a student in the shrubs heading to
the fast-food restaurant next door. As she perused the shrubs beside the school, she noticed a flash of white in the shrub. At first glance, she thought it was a piece of paper stuck in the shrub, but then it moved! Principal Johnson rushed over to the shrub to investigate. To her surprise, she found Daniel Morris hiding in the shrub. He did not seem surprised to see her as he greeted her. “Daniel, what are you doing out here?” Principal Johnson asked the student. She was not amused. His name was on her post-it note, which means he had been outside for over an hour. Principal Johnson shook her head as the boy responded, “I am waiting for my father to pick me up for a doctor’s appointment.” Principal Johnson looked at the eighth-grader and said, “you know the protocol is that you wait in the office for your parents to arrive.” This is not the first time Principal Johnson has caught Daniel absent after lunch. In fact, for such an intelligent young man, he is often not where he is supposed to be in school. Last month, he was caught in the bathroom when he should have been in English class. Daniel is a star athlete (basketball) and has lots of friends, but he tends to be a loner. His mother was recently deployed, and it is just he, his older brother, and his father who works long hours in the home. Principal Johnson asked him gently, “Daniel, please tell me why you are out here in the bushes.” There were rumors that Daniel sometimes brings “pills” to school from his older brother. One student reported seeing him selling the pills during lunch and between classes. This student said Daniel didn’t make the basketball team, so Principal Johnson wondered how reliable the report was from this student. Principal Johnson did not want any student to feel that it is okay to bring pills to school, so though this was not a priority, it was in the back of her mind when she ran into Daniel.
As they stood in the grass, Principal Johnson noticed that Daniel’s backpack was open and there was a bag with little pills in it on top. As she leaned over to look in the backpack, she asked Daniel to open his backpack so she could see the contents. Daniel hesitated but opened the backpack, and when he did, Principal Johnson saw what looked like a pad of hall passes that could have come from a teacher or an administrator. Principal Johnson made a mental note to remind teachers and administrators to watch their hall passes. Now Principal Johnson was very curious about what else could be in the bag. So, she dug a little deeper and found rolling paper used to smoke marijuana, some condoms, four $20 bills, and of course, the bag with pills. Daniel looked uneasy but did not say a word as the Principal went through his bag. Principal Johnson’s mouth fell open, and she said, “Daniel, can you explain any of these items in your backpack?” Principal Johnson asked him to follow her to the school office when Daniel refused to answer. Once in the school office, Principal Johnson put the backpack on the table and pulled out the bag of pills. She asked Daniel, “What kind of pills are these? Where are they from? Do you have any more pills?”. Daniel sat with his hands shoved in his jacket pockets and said the pills were for a sports injury and that they were in the bag that his father gave him. Principal Johnson asked him why he had $80 and where it came from. Daniel told her the money was to buy a video game from a friend. Principal Johnson did not like the answers Daniel was giving her and decided that she wanted to check the pockets of the hooded jacket Daniel was wearing. Daniel did not resist, but he did think it was unusual to have his coat searched. Principal Johnson did not find any more pills or money. She asked him to stand up, remove his jacket, and turn around. At that time, Principal Johnson noticed a bit of plastic coming out of the back of his pants. Principal
Johnson instructed Daniel to stand still why she attempted to pull the bit of plastic out of his pants from the back. Daniel jumped and moved forward and asked Principal Johnson what she was doing. Principal Johnson said that she thought the bit of plastic she saw was more pills, but it was a part of his pants. Daniel was very uncomfortable and told her that he wanted to call his father.
